Terms of Service - Flux

1. Acceptance of Terms
By downloading, installing, or using Flux (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Service
Flux is a digital wellbeing application that helps users manage their screen time and improve focus by:
- Tracking screen time using Apple’s Screen Time API
- Blocking distracting applications during focus sessions
- Providing insights and statistics about device usage
- Sending optional daily reminders
2.5 App Blocking Feature
How It Works
- Flux uses Apple’s Screen Time API to block access to selected apps
- You choose which apps to block and when
- Blocking can be activated manually or scheduled in advance
- Blocks are enforced by iOS, not by Flux directly
Important Limitations
- iOS Controls Blocking: Flux requests blocking through Apple’s Screen Time API. The actual blocking is performed by iOS, not by Flux.
- No Guarantee: We cannot guarantee 100% blocking effectiveness as this depends on Apple’s API and iOS system behavior.
- User Can Override: Users can disable Screen Time or change iOS settings to bypass blocks. Flux is a tool to help you stay focused, not a parental control system.
- System Limitations: Some system apps or critical functions may not be blockable due to iOS restrictions.
- API Changes: Apple may change the Screen Time API at any time, which could affect blocking functionality.
User Responsibility
- You are responsible for configuring your blocks appropriately
- Flux is designed as a self-help tool for adults seeking to improve focus
- Do not rely on Flux for critical functions (emergency access, important communications, etc.)
- We are not liable for any consequences of blocking, including but not limited to:
- Missed calls, messages, or notifications
- Inability to access specific apps when needed
- Any indirect consequences of being unable to access blocked apps
Emergency Access
- You can always access the Flux app to disable active blocks
- You can access Phone and Messages apps (unless you specifically choose to block them)
- In emergencies, you can disable Screen Time entirely through iOS Settings
- We recommend not blocking emergency services or critical communication apps
Disclaimer
Flux is a productivity and focus tool. It is NOT:
- A parental control application
- A medical or therapeutic device
- A guaranteed solution for phone addiction or compulsive behavior
- Intended to replace professional help for behavioral issues
3. User Accounts
3.1 Account Creation
- You must create an account to use certain features
- You must provide accurate and complete information
- You must be at least 13 years old to use Flux
- You are responsible for maintaining the security of your account
3.2 Account Security
- Keep your password confidential
- You are responsible for all activity under your account
- Notify us immediately of any unauthorized use at fluxaicapi@gmail.com
4. Subscriptions and Payments
4.1 Premium Features
- Flux may offer premium features through in-app subscriptions
- Subscriptions are managed through Apple’s App Store
- Prices are displayed in the app and may vary by region
- Premium features may include: advanced blocking schedules, detailed analytics, unlimited focus sessions
4.2 Billing
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- The cost of renewal will be the same as the original subscription price unless notified otherwise
4.3 Managing Subscriptions
- Subscriptions can be managed and auto-renewal can be turned off in:
- iOS Settings → Apple ID → Subscriptions
- App Store → Account → Subscriptions
- Cancellation takes effect at the end of the current billing period
4.4 Refunds
- Refunds are handled exclusively by Apple according to their refund policy
- Contact Apple Support directly for refund requests
- We do not have access to or control over Apple’s billing or refund processes
- No refunds will be provided for partial subscription periods upon cancellation
4.5 Free Trial (if applicable)
- Free trials may be offered for premium subscriptions
- You will be charged when the trial period ends unless you cancel before then
- Cancel anytime during the trial period to avoid charges
- Only one free trial per user
5. User Data and Privacy
5.1 Data Collection
- We collect and process data as described in our Privacy Policy
- Screen Time data is stored locally on your device
- Account data (email, preferences) is stored securely on our servers
- We use industry-standard encryption for data transmission
5.2 Screen Time API
- Flux uses Apple’s Screen Time API to access app usage data
- Screen Time data never leaves your device and is not transmitted to our servers
- We do not share Screen Time data with any third parties
- Data is used solely to provide app functionality (statistics, insights, blocking)
5.3 Your Rights
- You can view all your data within the app
- You can export your data at any time (Settings → Export My Data)
- You can delete your account and all associated data (Settings → Delete Account)

6. Acceptable Use
6.1 You Agree NOT To:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to hack, reverse engineer, decompile, or modify the App
- Share your account credentials with others
- Use automated tools, bots, or scripts with the App
- Interfere with the App’s operation, servers, or networks
- Violate any applicable local, state, national, or international law
- Impersonate any person or entity
- Upload or transmit viruses or malicious code
- Attempt to gain unauthorized access to other users’ accounts
6.2 Device Permissions
- Flux requires Screen Time permission to function properly
- You can revoke permissions at any time in iOS Settings
- Revoking Screen Time permission will disable most app features
- We only request permissions necessary for app functionality
6.3 Responsible Use
- Use Flux as intended: as a personal productivity and focus tool
- Do not use Flux to control or monitor other people without their consent
- Do not attempt to bypass iOS security features

7. Intellectual Property
7.1 Ownership
- Flux and all related content are owned by Flux Development
- App design, code, graphics, and branding are protected by copyright
- “Flux” name and logo are trademarks of Flux Development
- All rights not expressly granted are reserved
7.2 Limited License
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App
- This license is for personal, non-commercial use only
- You may not copy, modify, distribute, sell, or lease any part of the App
- You may not create derivative works based on the App
- This license terminates automatically if you violate these Terms
7.3 Feedback
- If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, worldwide, royalty-free license to use them
- We are under no obligation to implement any feedback
8. Third-Party Services
8.1 Apple Services
- Flux integrates with Apple’s Screen Time API and App Store
- Apple’s terms, conditions, and privacy policies apply to their services
- We are not responsible for Apple’s services, changes to APIs, or service interruptions
- Apple is a third-party beneficiary of these Terms and may enforce them
8.2 Authentication Services
- We may use third-party authentication services (e.g., Supabase)
- These services have their own terms and privacy policies
- We are not responsible for third-party service outages or data breaches
8.3 External Links
- The App may contain links to third-party websites or services
- We are not responsible for the content or practices of external sites
- Third-party terms and privacy policies apply when you use their services
9. App Updates and Changes
9.1 Updates
- We may release updates to fix bugs, improve performance, or add features
- Updates may be required to continue using the App
- We recommend keeping the App up to date for security and performance
- Updates are distributed through the Apple App Store
9.2 Changes to Features
- We reserve the right to modify, suspend, or discontinue any features at any time
- We will make reasonable efforts to notify users of significant changes
- Continued use after changes constitutes acceptance of the modified App
9.3 Changes to Terms
- We may update these Terms at any time
- Material changes will be notified through the App or via email
- Continued use after changes constitutes acceptance of the new Terms
- If you do not agree to updated Terms, you must stop using the App
10. Termination
10.1 Termination by You
- You may delete your account at any time through Settings → Delete Account
- Deleting your account permanently removes all your data from our servers
- Local data on your device may persist until you uninstall the App
- Active subscriptions must be cancelled separately through Apple
10.2 Termination by Us
We may suspend or terminate your account immediately if you:
- Violate these Terms or our policies
- Engage in fraudulent, abusive, or illegal activity
- Attempt to hack or compromise the App or other users
- Remain inactive for an extended period (we’ll notify you first)
- Use the App in a way that harms us or other users
10.3 Effect of Termination
- Your right to use the App immediately ceases
- We may delete your data according to our retention policies
- Sections that should survive termination (liability, disputes, etc.) remain in effect
- Paid subscriptions are non-refundable upon termination for cause
11. Disclaimers
11.1 “As Is” Service
- Flux is provided “AS IS” and “AS AVAILABLE” without warranties of any kind
- We make no warranties about the App’s reliability, availability, or performance
- We do not guarantee the App will be error-free, secure, or uninterrupted
- Your use of the App is at your sole risk
11.2 Screen Time Data
- Screen Time data accuracy depends on Apple’s API
- We are not responsible for inaccuracies in Apple’s data collection
- Data may not be 100% accurate due to iOS limitations or bugs
- Historical data may be incomplete or unavailable
11.3 Blocking Effectiveness
- We do not guarantee that app blocking will be 100% effective
- Blocking depends on Apple’s Screen Time API, which we do not control
- Users with technical knowledge may be able to bypass blocks
- iOS updates may affect blocking functionality
11.4 No Medical Advice
- Flux is not a medical device or therapeutic tool
- It does not diagnose, treat, cure, or prevent any medical condition
- It is not a substitute for professional medical or psychological help
- Consult qualified professionals for addiction, mental health, or behavioral concerns
11.5 No Guarantee of Results
- We do not guarantee that Flux will improve your productivity or focus
- Results vary based on individual usage and commitment
- Success depends on your active participation and self-discipline
12. Limitation of Liability
12.1 No Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Lost profits, revenue, data, or business opportunities
- Indirect, incidental, special, consequential, or punitive damages
- Damages from service interruptions, errors, or downtime
- Damages from third-party actions or services
- Damages from unauthorized access to your data
12.2 Maximum Liability
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF:
- The amount you paid us in the 12 months before the claim, OR
- $100 USD
12.3 Basis of the Bargain
These limitations apply even if we knew or should have known about the possibility of damages. These limitations are fundamental to our agreement.
13. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your content or data
- Your negligence or willful misconduct
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising from these Terms or the App shall be resolved exclusively in the competent courts of Tel Aviv, Israel. You consent to the personal jurisdiction of these courts.
Before filing a claim, you agree to contact us at fluxaicapi@gmail.com to attempt informal resolution. We’ll try to resolve disputes amicably before resorting to formal proceedings.
14.4 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.5 No Class Actions
You agree to resolve disputes individually, not as part of a class action or collective proceeding.
15. General
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
15.2 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
15.3 Assignment
You may not assign or transfer these Terms or your account. We may assign these Terms without notice or consent.
15.4 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, strikes, internet outages, etc.).
15.5 Language
These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

16. Apple-Specific Terms
16.1 Acknowledgment
- These Terms are between you and us, not Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support
- Apple is not responsible for any product liability claims
16.2 App Store Terms
- You must comply with Apple’s App Store Terms of Service
- You must comply with the Usage Rules in the App Store Terms
- The App is licensed, not sold
- Your license is non-transferable
16.3 Third-Party Beneficiary
- Apple and its subsidiaries are third-party beneficiaries of these Terms
- Apple has the right to enforce these Terms against you
- No other person or entity is a third-party beneficiary
16.4 Device Requirements
- The App requires:
- iOS 16.0 or later
- Screen Time permission
- Internet connection (for account features)
- Compatible iPhone or iPad
- We are not responsible for device compatibility issues
16.5 Intellectual Property
- In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for investigation, defense, settlement, or discharge of such claims
